01Acceptance of these terms
These Terms of Use ("Terms") are a binding agreement between you and Discover The Sanctuary ("we," "us," "our"), the publisher of https://thesanctuarylakewylie.com (the "Site"). By accessing, browsing, searching, linking to, or otherwise using the Site, you accept these Terms and our Privacy Notice, Cookie Notice, Rights of Use and Disclaimer, each incorporated by reference. If you do not agree, do not use the Site.
You represent that you are at least 18 years old, or the age of majority where you live, and that you are not barred from using the Site under applicable law or sanctions programmes. The Site is intended for users in the United States; if you access it from elsewhere, you do so on your own initiative and are responsible for local law compliance.
02What this site is — and is not
The Site is an independent editorial guide. It is not the homeowners association, developer, declarant or management company for The Sanctuary at Lake Wylie, is not endorsed by them, and is not a real-estate brokerage service, listing service, lender, appraiser or professional adviser.
No content on the Site is legal, tax, financial, insurance, engineering, appraisal, construction or real-estate advice; no attorney-client, agency, brokerage or fiduciary relationship arises from your use of the Site; and no content is an offer to sell or a solicitation of an offer to buy real property or any security.
03Limited licence to use the site
Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable licence to access and view the Site for your own non-commercial informational use. All other rights are reserved. Detailed content-reuse rules appear in Rights of Use & Copyright.
04Acceptable use
You agree not to, and not to permit any person or automated system acting for you to:
- copy, scrape, crawl beyond ordinary search-engine indexing, harvest, mirror, frame, or systematically download any part of the Site;
- use the Site or its content to train, fine-tune, ground or evaluate a machine-learning or generative AI system without our prior written consent;
- republish, resell, sublicense or commercially exploit content, photography, data, tables or code from the Site;
- circumvent, disable or test any security, rate-limiting or access-control feature, or probe the Site for vulnerabilities other than through a good-faith report to us;
- introduce malware, launch a denial-of-service attack, or impose an unreasonable load on the infrastructure;
- misrepresent your identity or your affiliation with us, the association or any partner firm, or use the Site to send unlawful, defamatory, harassing, deceptive or infringing material;
- use the Site for any unlawful purpose, or in violation of fair housing, consumer-protection, anti-spam, export-control or privacy laws.
We may investigate, block access, and pursue any remedy available at law or in equity for a violation, and we may preserve and disclose records where required by law or reasonably necessary to protect our rights, users or the public.
05Submissions and communications
If you send us an inquiry, correction, photograph, testimonial or other material (a "Submission"), you represent that you own or control the necessary rights and that the Submission is accurate and lawful. You grant us a worldwide, royalty-free, perpetual, irrevocable, sublicensable licence to use, reproduce, adapt and publish the Submission in connection with the Site, unless you tell us in writing that it is confidential before sending it.
Do not send confidential, privileged, health, financial-account, government-identifier or other sensitive information through the Site. Email and web forms are not secure channels.
06Third-party sites, firms and content
The Site links to and describes independent third parties, including builders, brokerages, designers, integrators, agencies, districts and utilities. We do not control them, do not warrant their licensing, insurance, performance or content, and are not a party to any agreement you make with them. Links and descriptions are for information and verification and are not endorsements or guarantees.
07Disclaimer of warranties
The site and all content are provided "as is" and "as available," with all faults and without warranty of any kind.
To the fullest extent permitted by law, we disclaim all warranties, express, implied, statutory or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, currency, and any warranty arising from course of dealing or usage of trade. We do not warrant that the Site will be uninterrupted, secure, error-free, or free of harmful components, or that any defect will be corrected. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
08Limitation of liability
To the fullest extent permitted by law, neither Discover The Sanctuary nor its owners, officers, employees, contributors, contractors, licensors or agents will be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost savings, lost opportunity, loss of data, loss of goodwill, business interruption, diminution in property value, transaction costs, or costs of substitute services, arising out of or relating to your use of, or inability to use, the Site or its content — whether based in contract, tort (including negligence), strict liability, statute or otherwise, and even if advised of the possibility of such damages.
Our total aggregate liability for all claims relating to the Site will not exceed one hundred U.S. dollars (US $100). You acknowledge that these limitations are an essential basis of the bargain and that the Site is provided without charge in reliance on them. Nothing in these Terms excludes liability that cannot lawfully be excluded, including for fraud or wilful misconduct.
09Assumption of risk and verification duty
You accept that information about communities, covenants, dues, boundaries, shorelines, permits, taxes, schools and market conditions changes frequently and may be reported inaccurately by primary sources. You assume all risk of relying on the Site, and you agree to verify any material fact with the association, the relevant agency or a licensed professional before acting on it.
10Indemnification
You agree to defend, indemnify and hold harmless Discover The Sanctuary and its owners, officers, employees, contributors, contractors, licensors and agents from and against any claim, demand, action, loss, liability, damage, cost or expense (including reasonable attorneys' fees) arising out of or related to your use of the Site, your Submissions, your violation of these Terms, or your violation of any law or third-party right.
11Governing law, venue and dispute resolution
These Terms are governed by the laws of the State of North Carolina, USA, without regard to conflict-of-law principles. You and we agree to first attempt in good faith to resolve any dispute informally by writing to npeters@yourleaderinluxury.com and allowing thirty (30) days to resolve it.
If the dispute is not resolved, it will be brought exclusively in the state and federal courts located in Mecklenburg County, North Carolina, and you consent to personal jurisdiction and venue there. Each party waives any right to a jury trial and to participate in a class, collective or representative action, to the extent permitted by law. Any claim must be brought within one (1) year after it arises or it is permanently barred, unless a longer period is required by law.
12Changes, severability and entire agreement
We may modify these Terms at any time by posting a revised version with a new effective date; continued use after posting constitutes acceptance. The current version is effective August 1, 2026.
If any provision is held unenforceable, it will be limited or severed to the minimum extent necessary and the remainder stays in force. Our failure to enforce a provision is not a waiver. These Terms, with the documents incorporated by reference, are the entire agreement between you and us regarding the Site and supersede any prior understanding. You may not assign these Terms; we may assign them in connection with a transfer of the Site. Sections that by their nature should survive termination — including disclaimers, limitation of liability, indemnity and dispute resolution — survive.
